Arco International S.r.l. (VAT: 02354510980), with its legal headquarters at Via Sostegno 6/B 25124 – Brescia (BS), as the Data Controller pursuant to Articles 4, paragraph 7 and 24 of EU Regulation No. 2016/679 (GDPR), informs you that, in accordance with Article 13 of the GDPR, it is presenting below the cookie policy (“Policy”) applicable only to this website https://arcointernational.it/ (“Site”).
1. Legal Framework
1.1. This Policy is inspired by the following European and/or national regulations (of the first and/or second level): (i) Directive No. 2002/58/EC of 12.07.2012 (so-called ePrivacy Directive), as amended by Directive No. 2009/136/EC; (ii) Article 122 of the amended Legislative Decree No. 196/2003 (Privacy Code), which implemented the ePrivacy Directive into national law; (iii) GDPR: Articles 4, paragraph 11), 7, 12, 13, 25, and 95 (in particular, Recitals 30, 32, and 173); (iv) Guidelines No. 5/2020 adopted on 04.05.2020 by the EDPB, replacing the Guidelines of 10.04.2018 signed by the WP Article 29; (v) Provision No. 231 of 10.06.2021 [doc. web No. 9677876] signed by the Data Protection Authority (Garante Privacy); (vi) Recommendation No. 2/2001 by WP Article 29; (vii) Opinion No. 2/2010 by WP Article 29; (viii) Opinion No. 4/2012 by WP Article 29; (ix) Guidelines No. 8/2020 by the EDPB.
2. Cookies and Other Tracking Tools: Definition and Classification
2.1. “Cookies” are generally text strings that a website (“publisher” or “first-party”) visited by the user or another website (“third party”) places and stores, either directly (in the case of the first-party website) or indirectly (through the first-party website, in the case of the third-party website), on a device terminal available to the user. The Data Protection Authority has specified that information encoded in cookies can include both personal data under Article 4, paragraph 1) of the GDPR (e.g., IP address; username; email address; unique identifier) and non-personal data under Article 3, paragraph 1) of EU Regulation No. 1807/2018 (e.g., language; device type used).
In addition (or beyond) cookies, there may be other “tracking tools” which can be divided into “active” (having almost the same characteristics as cookies) and “passive” (e.g., fingerprinting).
2.2. Aside from the intrinsic characteristics described above, cookies (and other tracking tools) can record different characteristics in terms of time (and, therefore, be considered as “session” cookies or “persistent” cookies, depending on their duration), subjectivity (whether the publisher acts independently or on behalf of a “third party”), and finally (and particularly) based on the purpose of processing pursued, and thus can be divided into two main categories:
- “Technical” cookies, used solely for the purpose of “carrying out the transmission of a communication over an electronic communications network, or to the extent strictly necessary for the provider of an information society service explicitly requested by the contract or user to provide such service” (Article 122, paragraph 1 of the Privacy Code).
In this regard, the Data Protection Authority has highlighted in Provision No. 231 of 10.06.2021 (in line with the previous 2014 Provision) that “analytics cookies” can be classified as “technical” cookies (and thus can be used without the prior consent of the data subject) under certain conditions that prevent the direct identification of the individual concerned.
- “Profiling” / “marketing” cookies (so-called non-technical), used to associate specific actions or recurring behavior patterns in using the services provided with certain individuals, either identified or identifiable, in order to group different profiles into homogeneous clusters of varying sizes. This allows the Data Controller to, among other things, tailor the service delivery in a more personalized manner, beyond what is strictly necessary for service provision, and also to send targeted advertising messages (aligned with the preferences shown by the user during web navigation).
